DONATIONS

SECTION 18(A) APPROVAL BY SARS

The Dance for PD SA NPC has been approved as a Public Benefit Organisation (PBO) for purposes of section 18A (1) (a) of the Act and donations to Dance for PD SA NPC will be tax deductible in the hands of the donors in terms of and subject to the limitations prescribed in section 18A of the Act with effect from 4 April 2019.

Donations made to or by the PBO are exempt from Donations Tax in terms of section 56(1) (h) of the Income Tax Act.

Exemption from the payment of Estate Duty in terms of section 4(h) of the Estate Duty Act No.45 of 1955.

  1. INFORMATION PERTAINING TO S18A DONATIONS WHAT IS CONSIDERED A BONA FIDE DONATION FOR S18A PURPOSES.

    A bona fide donation is a voluntary, gratuitous gift disposed of by the donor out of liberality or generosity, where the donee is enriched and the donor impoverished. There may be no quid pro quo, no reciprocal obligations and no personal benefit for the donor. If the donee gives any consideration at all, it is not a donation.

    The donor may not impose conditions, which could enable him or any connected person in relation to himself to derive some direct or indirect benefit from the application of the donation.

  2. BONA FIDE DONATION FOR S18A PURPOSES

    Projects/funds approved by the DPSA - NPC from time to time

  3. EXAMPLES OF WHAT DOES NOT CONSTITUTE A BONA FIDE DONATION FOR PURPOSES OF SECTION 18A?

    1. Donation of services rendered such as a professional person renders a skill free of charge.
    2. An amount paid for attending a fundraising dinner, dance or charity golf day.
    3. The amount paid for the successful bid of goods auctioned to raise funds by an organisation and Memorabilia, paintings, etc., donated to be auctioned to raise funds
    4. Amounts paid for raffle or lottery tickets.
    5. Amounts paid for school fees, entrance fees for school admittance or compulsory school levies.
    6. Value of free rent, water and electricity provided by a lessor to the lessee , which is an approved PBO.
    7. Payments of debt owed by an organisation approved under section 18A. An example would be the cost of repairs to a vehicle, which is paid to the service station on behalf of the PBO and is not paid directly to the PBO.
    8. Prizes and sponsorships donated for a fundraising event such as a charity golf day.
    9. Tithes and offerings to churches or other religious organisations for religious activities.
    10. Membership subscription fees.
    11. Donation of services rendered
    12. The donation of a service such as time, skill or effort to an approved organisation will not qualify as a deduction for purposes of section 18A as a service is not a donation of "property made in kind".
    13. For example, a professional person such as an auditor, artist (including a singer, musician or entertainer), medical doctor, lawyer, accountant, plumber or electrician who renders a service free of charge to an approved organisation will not be entitled to a tax deduction for the value of the service.
  4. CASH DONATION

    The donation may be made in cash (money). This includes payments by electronic fund transfer, credit card, postal order or debit card.
    As noted above, the donation must actually be paid or transferred during the year of assessment to the organisation approved under section 18A.
    Promissory notes, pledges, payments to be made in future instalments or post-dated cheques do not qualify.
    Only after a donation has appeared in the DPSA -NPC bank account, an 18A certificate will be issued to the donor (not available for anonymous donors).

  5. DEPOSITS

    We require the following details to appear on all deposits:

    • Full names
    • The project where donation must be allocated to
    • Email address
    • Rand amount
